Well id say it was a biscuit but here is a debate that took place 7mth ago just about whether a kit kat was a sweet or biscuit ! SURELY these people have other stuff to do ???? haha.

yet.again.a.biscuit!!!!!!.....cakes.are.messy.and.indulgent!!.......jaffa.cakes.are.also.dunkable!!!!!!!

well a kit kat for me is a biscuit but a jaffa cake well......me and scott had this discussion as well........when a cake has been lying it goes hard but when a biscuit has been lying it goes soft so there for its really a cake
but im with u janis a cake to me is a big creamy messy thing lol Laughing

i guess they both fall under the biscuit category for me. i have added the best rap in the world on biscuits from two pints of lager and a packet of crisps.

it was passed in a court of law as being a cake which means VAT is not applied to it.
